RSL NSW Act 2018
As you may be aware, the RSL NSW Act 2018 has now been proclaimed to commence on 31 December 2018. It will commence operation on that day.
The proclamation and commencement of the Act happens as a matter of parliamentary process, and at the discretion of the Minister. It is not dependent on what our internal RSL NSW Constitution says.
Even though RSL NSW’s current Constitution is inconsistent with the terms of the new Act, the Act will nevertheless apply from 31 December. As we have been discussing with sub-Branches over the past few months, this is one of the key drivers for the need to change to our Constitution. We must bring it into line with the Act.
From the commencement date the legal identity of RSL NSW stays the same but the law says that RSL NSW continues to exist ‘as newly constituted’.
This means that from 1 January 2018, RSL NSW will have a Board of directors of at least 3 but not more than 10, with at least 1 of those directors (but not more than 2) being independent directors. The Act says that the current State Council will be the Board until the end of their term.
The Act requires the Board to ‘as soon as practicable’ after the commencement date, appoint the independent director/s, which means this process will take place early next year.
Members will be informed of the process accordingly.
All other provisions of the Act will also come into effect from 31 December 2018.

2019 Extraordinary Congress

The 2019 Extraordinary Congress will be held in Albury from the 27th– 28th May in Albury.
